These Terms and Conditions govern your use of swiss preen's website and watch repair services. By accessing our website or using our services, you agree to be bound by these terms.
If you do not agree with any part of these terms, please do not use our website or services. We reserve the right to modify these terms at any time, with changes becoming effective upon posting to our website.
1. Definitions
- "Service" refers to watch repair and restoration services provided by swiss preen
- "User" or "You" means any person accessing our website or using our services
- "Content" includes all text, images, information, and materials on our website
- "We", "Us", or "Our" refers to swiss preen
- "Timepiece" means any watch or clock submitted for service
2. Service Terms
2.1 Service Provision
Our watch repair services are provided for personal use. Users must be at least 18 years old or have parental consent. All service requests are subject to our acceptance and capacity.
2.2 Estimates and Pricing
We provide written estimates after examining your timepiece. Estimates are valid for 30 days. If unforeseen issues arise during service, we will contact you for approval before proceeding with additional work.
2.3 Service Timeline
Service timelines are estimates and may vary based on parts availability, complexity, and workload. We will inform you of any significant delays. Timelines do not constitute binding commitments unless explicitly stated in writing.
2.4 Payment Terms
Payment is due upon completion of service before timepiece release. We accept cash, credit cards, and e-transfers. Prices are in Canadian dollars and include applicable taxes.
3. User Responsibilities
3.1 Accurate Information
You must provide accurate and complete information about your timepiece, including known issues, previous repairs, and special concerns. Failure to disclose relevant information may affect service quality and outcomes.
3.2 Ownership Verification
You represent that you are the legal owner of timepieces submitted for service or have authorization from the owner. We reserve the right to request proof of ownership.
3.3 Timepiece Condition
You acknowledge that vintage and antique timepieces may have inherent fragility. We will exercise reasonable care, but some risks exist in servicing delicate or aged mechanisms.
4. Prohibited Uses
Users may not:
- Violate any applicable Canadian laws or regulations
- Infringe on intellectual property rights of swiss preen or third parties
- Transmit harmful code, viruses, or malicious software through our website
- Attempt unauthorized access to our systems or customer data
- Engage in fraudulent activities or misrepresent information
- Harass, threaten, or harm our staff or other customers
- Use our services for illegal purposes or to facilitate illegal activities
- Reproduce our content without written permission
5. Intellectual Property Rights
All content on this website, including text, images, logos, and design elements, remains the property of swiss preen. You are granted a limited license for personal, non-commercial use.

6.1 Service Warranty
We provide a 12-month warranty on labor for services performed. This warranty covers defects in our workmanship but does not cover normal wear, abuse, or damage from improper use. Original parts and materials carry manufacturer warranties when applicable.
6.2 Limitations
Services are provided based on our professional judgment and available resources. We make no guarantees regarding:
- Achieving chronometer-grade precision in vintage timepieces
- Availability of original or period-correct parts
- Restoration of severely damaged components
- Specific aesthetic outcomes in dial or case restoration
6.3 Inherent Risks
You acknowledge that watch repair involves inherent risks, particularly for vintage, delicate, or previously damaged timepieces. While we exercise reasonable care, unexpected complications may arise during service.
7. Limitation of Liability
To the maximum extent permitted by Canadian law:
- Our liability is limited to the service fees paid for the specific work performed
- We are not liable for indirect, consequential, or incidental damages
- We are not liable for loss of use, sentimental value, or opportunity costs
- We are not liable for damage resulting from pre-existing conditions not disclosed
- Our liability does not exceed the current market value of the timepiece
You assume risk when entrusting timepieces for service. We recommend insurance coverage for valuable pieces.
8. Unclaimed Property
Timepieces not collected within 90 days of service completion notification will incur storage fees of $10 per month. After 180 days, we may dispose of unclaimed property according to Quebec law, with proceeds applied to outstanding fees.
We will make reasonable efforts to contact you before disposal, including email and certified mail to your last known address.
9. Dispute Resolution
9.1 Informal Resolution
If disputes arise, we encourage initial contact with our management team to seek informal resolution. Many concerns can be addressed through direct communication.
9.2 Mediation
If informal resolution fails, parties agree to attempt mediation before pursuing formal legal action. Mediation costs will be shared equally.
9.3 Governing Law
These terms are governed by the laws of Quebec and Canada. Disputes will be resolved in the courts of Montreal, Quebec.
9.4 Small Claims
Either party may pursue claims in small claims court if the amount in controversy falls within court jurisdiction.
10. Cancellation and Refunds
You may cancel service requests before work begins for a full refund of any deposit paid. Once work has commenced:
- You are responsible for work completed to date
- Diagnostic fees are non-refundable
- Parts ordered specifically for your timepiece are non-refundable
- We will return your timepiece in its current state upon payment for completed work
Cancellation requests must be submitted in writing via email or in person.
11. Insurance and Liability Coverage
We maintain business insurance covering general liability and property in our care. Coverage limits apply, and we recommend you maintain your own insurance for valuable timepieces. Our insurance does not cover:
- Sentimental value beyond market value
- Damage from pre-existing conditions
- Losses due to acts of nature or events beyond our control
- Depreciation or diminution in value
12. Force Majeure
We are not liable for delays or failure to perform obligations due to circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, fires, floods, or severe weather
- Pandemic, epidemic, or public health emergency
- War, terrorism, or civil unrest
- Government actions or restrictions
- Strikes or labor disputes
- Supplier failures or parts unavailability
- Equipment failure or power outages
13. Termination
We reserve the right to refuse or terminate service to any customer who:
- Violates these terms and conditions
- Engages in abusive or threatening behavior toward staff
- Provides false or misleading information
- Has outstanding unpaid balances
- Presents illegal or stolen property
Upon termination, you must immediately pay for all services rendered and collect your property.
14. Modifications to Terms
We reserve the right to modify these terms at any time. Material changes will be communicated through:
- Notice posted on our website
- Updated "Last Modified" date at the top of this page
- Email notification to customers with active service orders
Continued use of our services after changes constitutes acceptance of modified terms.
15. General Provisions
15.1 Entire Agreement
These terms, together with our Privacy Policy and any written service agreements, constitute the entire agreement between you and swiss preen.
15.2 Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full effect.
15.3 No Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
15.4 Assignment
You may not assign or transfer your rights under these terms. We may assign our rights to any successor or affiliate.
